These Terms and Conditions (the Terms) govern your use of the Lushka website at lushkacosmetic.myshopify.com (the Website) and any order you place through it. The Website is operated by LUSHKACOSMETICS LTD, trading as Lushka (Lushka, we, us or our), of 68 Nantwich Drive, Edinburgh, Scotland, EH7 6RB. Our company number is SC874765.
By using the Website or placing an order, you agree to these Terms. Please read them before ordering.
1. Contact details
For questions about an order, a return or these Terms, email Lushkacosmetics@gmail.com. Return requests must be made by email and authorised before goods are sent back.
2. Who may place an order
You must be at least 18 years old and legally capable of entering into a contract. You must provide accurate, current and complete information when ordering and keep your account credentials secure.
3. Products and descriptions
We take reasonable care to display product descriptions, colours, measurements and images accurately. Screen settings and natural variations may cause minor differences. Product packaging may vary from images where a manufacturer changes it, provided the product itself is not materially different.
You are responsible for reading all product information, ingredients, directions, warnings and suitability information before use. Stop using a product and seek appropriate advice if you experience an adverse reaction.
4. Orders and contract formation
Submitting an order is an offer to buy the selected products. An automated acknowledgement confirms only that we received the order. A binding contract is formed when we send a dispatch confirmation, unless applicable law provides otherwise.
We may reject or cancel an order before dispatch if, for example, a product is unavailable, information or pricing is incorrect, payment is not authorised, we suspect fraud or misuse, or delivery restrictions apply. If we cancel after taking payment, we will refund the amount paid.
If you wish to cancel or change an order before dispatch, you must email Lushkacosmetics@gmail.com within 24 hours after placing it. We will try to action the request, but we cannot guarantee cancellation because orders may be processed or dispatched sooner. Once an order has been dispatched, it cannot be recalled through our order-cancellation process; you must receive it and follow the authorised return process in our Refund and Returns Policy. A refund for a dispatched order will be processed only after the returned item has been received and inspected, subject to any different timing required by law. This operational rule does not limit any cancellation right that applicable law gives you.
5. Prices and payment
Prices are shown in pounds sterling (GBP). Delivery charges are displayed before checkout. You authorise us and our payment provider to charge the payment method selected at checkout.
If a price is clearly incorrect, we may cancel the affected order and refund any payment rather than supply at the incorrect price.
6. Delivery
Available delivery methods and charges are shown at checkout. Standard delivery is expected to arrive within 3–5 working days after dispatch, and express delivery within 1–2 working days after dispatch. Delivery dates are estimates unless we expressly agree otherwise. You must provide a complete and accurate delivery address.
Risk of loss or damage passes to you when the order is delivered to you or a person identified by you, except where applicable law provides otherwise. Ownership passes when we receive full payment.
If a parcel appears lost, damaged or incorrectly delivered, email Lushkacosmetics@gmail.com promptly with your order number and supporting information.
7. Returns, cancellations and refunds
All sales are final except for returns expressly accepted under our Refund and Returns Policy or where your mandatory legal rights apply.
For an eligible change-of-mind return, you must email Lushkacosmetics@gmail.com within 14 days after delivery. Products must be unused, unopened, undamaged and in exactly their original condition, with all seals, labels, accessories and original packaging intact, together with proof of purchase. Returns must be authorised by email before they are sent.
Opened or unsealed products that are not suitable for return for health-protection or hygiene reasons cannot be returned for a change of mind once their seal has been broken. Other exclusions and the full return process are set out in the Refund and Returns Policy.
Nothing in these Terms limits rights that cannot lawfully be excluded, including rights relating to faulty, damaged, unsafe or misdescribed goods.
8. Promotions, discount codes and gift cards
Promotions and discount codes are subject to any additional terms stated with the offer. Unless stated otherwise, codes cannot be combined, exchanged for cash, applied retrospectively or used after their expiry date. We may withdraw a promotion where reasonably necessary, without affecting orders already accepted.
Gift cards are subject to the terms shown when purchased and are not redeemable for cash except where required by law.
9. Website use
You must not:
- use the Website unlawfully or fraudulently;
- interfere with its security, operation or availability;
- introduce malicious code, scrape the Website without permission or attempt unauthorised access;
- misuse product reviews, discount codes or purchasing limits; or
- infringe our rights or the rights of another person.
We may suspend or restrict access where reasonably necessary to protect the Website, our customers or our business.
10. Intellectual property
The Website and its content—including text, graphics, photographs, logos, product names, design and software—are owned by or licensed to Lushka and are protected by intellectual-property laws. You may use the Website only for personal, non-commercial shopping. No other use, copying or distribution is permitted without our prior written permission.
11. Third-party services and links
The Website may use or link to third-party services, such as payment, delivery or social-media services. We are not responsible for third-party websites or services that we do not control. Their own terms and privacy notices may apply.
12. Our responsibility to you
We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your mandatory consumer rights.
Subject to the previous paragraph, we are not responsible for losses that were not reasonably foreseeable when the contract was formed, for losses caused by information or instructions you supplied, or for business losses arising from a consumer purchase. The Website is provided for private and domestic use unless we expressly agree otherwise.
13. Events outside our control
We are not responsible for delay or failure caused by events beyond our reasonable control. We will take reasonable steps to reduce the effect of the event and contact you where it materially affects your order. Your legal rights remain unaffected.
14. Privacy and cookies
Our Privacy Policy explains how we use personal information. Information about cookies should also be provided through our cookie notice or consent tool.
15. Changes to these Terms
We may update these Terms from time to time. The version in force when your order is accepted will apply to that order. Any new version will be posted on this page with a revised effective date.
16. General terms
If any part of these Terms is found unlawful or unenforceable, the remaining parts will continue in effect. A delay in enforcing a right is not a waiver of that right. You may not transfer your rights under an order without our written consent; we may transfer ours where this does not reduce your legal rights.
17. Governing law and disputes
These Terms and any non-contractual dispute are governed by the laws of Scotland. The courts of Scotland will have jurisdiction, except that a consumer may retain any right under mandatory law to bring proceedings in the place where they live.
